St Mungo's consultation on Government plans to review and change supported housing regulations

The UK Government consulted on changes to supported housing regulations, focusing on implementing the Supported Housing (Regulatory Oversight) Act 2023 in England. The proposals included a locally led licensing system and new national standards. Additionally, the Government is considering changes to Housing Benefit Regulations across Great Britain.
St Mungo’s has provided feedback that will help shape licensing regulations and Housing Benefit modifications. We have called on the Government to:
  • Set a clear, finite regulatory pathway for commissioned providers
  • Amend the licensing regime so that support providers are the licensees, rather than landlords.
  • Define all frontline activity as ‘support’ within Housing Benefit regulations.
  • Ensure the level of care, support or supervision provision reasonable to be eligible for Housing Benefit under specified accommodation rules encompasses low needs supported housing.
  • Ensure evidence required for Housing Benefit claims recognises assessments and evidence which is already held by the local authority.
Once the responses have been reviewed, the Government will publish its conclusions and outline the timeline for implementing the new system.
